The Alabama Accountability Act Unconstitutional

A Montgomery judge finds the Alabama Accountability Act unconstitutional.

Circuit Judge Gene Reese ruled that Alabama’s tax credits for parents who move their children from failing public school to private schools violates the state Constitution’s requirement for the Legislature to have only one subject in a bill. Reese says the ruling will not affect the tax credits earned for the 2013 through 2014 school year. The law was challenged in court by members of the Alabama Education Association. The Legislature passed the law in 2013. The ruling will be appealed by the Institute for Justice.
