Animal Abuse

On November 20 the Anniston Police Department were notified of a possible Animal Abuse offense that had occurred at Damn Yankee’s Oyster Bar, located at 919 Noble Street. According to Anniston Police Department Captain Allen George, during the investigation, witnesses described seeing an individual on the second story balcony area, repeatedly striking a dog with a piece of garden hose. Witnesses stated that the dog was yelping in pain and that the dog ran in an attempt to get away from the individual and fell or jumped from the second story balcony, landing on the concrete alleyway below.

The witnesses said that the dog was bleeding from the mouth and was eventually picked up by the individual that was observed striking the dog. As Officers investigated the case 49-year-old David Martin Mogil of Anniston and 30-year-old Mary Allison Barrett refused to tell Officers where the dog was taken after the incident. The case was presented to the Calhoun County District Attorney’s Office on November 21 and a warrant was issued for Mogil for Aggravated Cruelty to Animals. The warrant currently is listed as No Bond. Barrett was also arrested for Hindering Prosecution 2nd. At the time of this release, no bond has been set for Johnson. The incident is still under investigation.
