Testimony is complete in the sentencing phase for an Etowah County grandmother convicted of running her granddaughter to death in 2012. Today, the jury listened to nearly four hours of testimony from defense witnesses. Those taking the stand included Garrard's daughter and her husband. The jury must now decide whether to recommend death or life without parole to Judge Billy Ogletree, who has the final say on Garrrard's capital murder punishment. The jury will return for closing arguments in the sentencing phase tomorrow morning and they could begin deliberations by the afternoon.
Judge Ogletree has not commented on a defense motion to throw out the case over allegations of juror misconduct but those inside the courtroom today say there was one juror who was not present.
