Anniston Business Man Goes to Trial for Animal Cruelty

Trial got underway today for a former Anniston business owner charged with aggravated cruelty to animals. Police arrested Dave Mogil last November. At the time, he owned and operated Damn Yankee's Oyster Bar on Noble Street, which is now closed. Witnesses told police they saw a person on the bar's second story balcony beating a dog with a garden hose. They also told police that the dog appeared to jump or fall from the balcony and hit the ground below. Witnesses also said the dog was bleeding from its mouth and that the person who was seen beating the dog, also picked it up from the ground and left with it. When officers went to investigate, they said Mogil refused to tell them where the dog was. Both Mogil and his girlfriend were arrested and charged with hindering prosecution.
