A capital murder case in Etowah County will move forward to a grand jury. A judge made the ruling Monday after a preliminary hearing for Albert Gargone. He’s charged in the death of Kevin Winston.
On January 7th, Gadsden Police responded to a call in the 2800 block of Shahan Avenue. When officers arrived, they found Winston in the backseat of a vehicle suffering from a gunshot wound to the head.
Once medics arrived, Winston was pronounced dead. Gargone was arrested within hours of the shooting.
